Camp Lucy Rules and Regulations

These Camp Lucy Rules and Regulations apply to your use of the Venue for your Event and supplement the terms of the Event Agreement (the “Agreement”) entered into by you and Whim Hospitality, LLC and Camp Lucy, LLC (“we” and “us”). These Rules and Regulations are incorporated into and made part of the Agreement. Capitalized terms not defined have the meaning given to them in the Agreement. These Rules and Regulations may be amended from time to time by us upon providing you prior written notice. By entering into the Agreement, you agree to be bound by these Rules and Regulations and additional terms of service.

Condition of Venue. When you take possession of the Venue for the Event, you will conclusively establish that the condition of the Venue is acceptable for your purposes. Defacing of buildings, landscaping, equipment and/or fixtures is prohibited. The Venue is not the only venue at Camp Lucy, and you understand that you have no right to use any portion of Camp Lucy other than the Venue.

Legal Requirements. You will obey all laws, ordinances and regulations applicable to the use and occupancy of the Venue. You must comply with all event curfew requirements, sound requirements and traffic control requirements.

Entertainment. All aspects of entertainment to be provided during the event are subject to our prior written approval, including lighting, sound, staging and crew.

Music, Sound Levels and Noise. The Venue adjoins residential areas and private ranches. Sound shall be kept within required levels at all times. Amplified sound within the Venue’s event hall may not exceed 90 decibels. Amplified sound may not exceed 50 decibels at any property line of Camp Lucy. Low volume (under 50 decibels) amplified sound is permitted outside of buildings or within covered, open air areas only (a) during a wedding ceremony and (b) in locations approved in advance by us. No amplified sound will be allowed outside of the event hall at any other time. You must respect adjacent property owners at all times; honking horns, car alarms, noise making devices and any other excessive noise is prohibited. Staff shall have absolute discretion over noise control at the Venue. We expressly retain the right to require the removal of any guest or vendor who is violating the prohibition against excessive noise or to cut electric power to amplification equipment.

Smoking. Smoking is permitted only within designated areas approved by us. Staff has an absolute right to prohibit smoking at the Venue during periods of high fire hazard in Hays County.

Curfew. The Venue must be vacated by guests by 12:00 a.m. midnight every day of the week. This deadline does not include the one hour clean up period. Any additional clean up time is not permitted unless prior arrangements are made at least thirty (30) days prior to the event.

Parking. Parking is limited to the areas of the Venue specifically designated for parking. Parking or driving on non-paved areas and on Creek Road is prohibited. We are not responsible for theft or damage to any vehicle or possessions.

Traffic Control. If more than one hundred ten (110) vehicles are anticipated, we may require that you provide traffic control using off duty law enforcement personnel. Traffic control personnel must arrive at least thirty (30) minutes before the stated start time of the event through thirty (30) minutes after the actual end of the event.

Open Flames. No open flames, candles (other than votive candles contained within glass votive holders), fire pits, barbeque pits or similar devices are permitted on the Venue.

Use of Confetti, Etc. Glitter, confetti, birdseed and sparklers are prohibited. Only rose petals and bubbles may be thrown or released on the Venue. All rose petals must be removed during cleanup.

Security and Safety Regulations. You are solely responsible for the conduct and behavior of persons using the Venue for the event, including your agents, employees, invitees, licensees and visitors. If Staff determines that additional security is required due to inappropriate behavior, you will pay the cost of such security. We may limit the number of people in any building or floor for safety reasons or for crowd and parking control. All hallways, entryways, aisles, driveways, motor courts and parking areas shall remain clear of obstacles. You will ensure that no person entering the Venue engages in any criminal activity, including illegal drug use. You will ensure that children under the age of 12 are supervised by an adult at all times. We are not responsible for theft or damage to any personal possessions before, during or after the event.

Hazardous Materials; Fireworks. No explosives, fireworks, pyrotechnics, toxic materials, or substances defined as hazardous wastes, hazardous materials, or hazardous substances under any law or regulation (“Hazardous Materials”) are allowed.

Failure to Remove Personal Property. Any items that you fail to remove from the Venue after the event shall be deemed abandoned, and we may retain, destroy and/or dispose of such items at your expense and/or may charge you for the cost of additional rental and/or storage for such items.

Incident Reporting. You must immediately report to the on-site representative, and shall report directly to Manager within twenty-four (24) hours of the Event, all accidents occurring on the Venue or in connection with the event. In the event of any claim asserted against us or the Venue, you must provide us with copies of every process, pleading or paper relating to any such claim, and shall cooperate fully with us in connection with any such claim.
